1. OUR COMMITMENT TO INTELLECTUAL PROPERTY
Guidenim (https://guidenim.com/) deeply respects the intellectual property rights of artists, designers, and brands. As a creative platform specializing in Print-on-Demand (POD) apparel and accessories, we take pride in the originality of our collections. Our business, headquartered in Tacoma, Washington, operates with the principle that creativity should be celebrated and protected.
We strive to ensure that all products sold on our site—from graphic T-shirts to custom tote bags—do not infringe upon the trademark or copyright of any third party. However, since we work with various designers and independent contributors, we have established this Intellectual Property Claim policy to address any potential concerns swiftly and legally.
2. REPORTING INFRINGEMENT (DMCA NOTICE)
If you are a copyright owner or an agent thereof and believe that any content on our site infringes upon your intellectual property rights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”).
To be effective, the notification must be a written communication sent to our designated agent at support@guidenim.com and must include the following information:
A Physical or Electronic Signature: The signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Identification of the Work: Clear identification of the copyrighted work claimed to have been infringed (e.g., a link to your original artwork or a registration number).
Identification of the Infringing Material: A description and the specific URL of the material on Guidenim that you claim is infringing, so that we may locate it accurately.
Contact Information: Your address, telephone number, and email address.
A Statement of Good Faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.
3. OUR RESPONSE PROCEDURE
Upon receipt of a valid and complete infringement notice, Guidenim will take the following actions:
Immediate Investigation: Our legal and design teams in Tacoma, WA, will review the claim within 24–48 hours.
Removal of Content: If the claim appears valid, we will promptly remove or disable access to the allegedly infringing material.
Notification to the Provider: We will notify the designer or contributor responsible for the content that a claim has been made and that the material has been removed.
4. COUNTER-NOTIFICATION PROCESS
If you believe that your content was removed by mistake or misidentification, you may submit a counter-notification to us. Your counter-notice must include:
Your physical or electronic signature.
Identification of the material that was removed and the location where it appeared before removal.
A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Tacoma, Washington, if your address is outside of the United States).
5. TRADEMARK COMPLAINTS
The above process applies to copyright. If your complaint is regarding a Trademark (such as a brand name or logo), please provide the following:
The specific trademark being infringed.
The registration number (if applicable).
The jurisdiction of the registration.
A description of how the trademark is being misused on our site.
6. REPEAT INFRINGER POLICY
Guidenim maintains a strict “Repeat Infringer” policy. In accordance with the DMCA and other applicable laws, we reserve the right to terminate, in appropriate circumstances and at our sole discretion, the accounts of designers or users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the site for any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
7. LIMITATION OF LIABILITY
By using our site, you acknowledge that Guidenim is a service provider and that we are protected by the “Safe Harbor” provisions of the DMCA. While we make every effort to screen content, we are not liable for any indirect or consequential damages resulting from intellectual property disputes between third parties.
